Hunter Moore, a man known as the “King of Revenge Porn,” recently plead guilty to identity theft and federal computer hacking for allegedly stealing nude photos of women and posting them online. Moore, 26, reportedly received nude photos of women from individuals seeking revenge and published them. He also allegedly published illicit photos that were obtained illegally from various email accounts.

He will be sentenced in June and is facing a seven-year prison sentence. 1

California Revenge Porn Laws

California’s new revenge porn laws will be strongly enforced.

In 2014, California began enforcing a new law that makes it a crime to create and distribute revenge porn. California Penal Code 647(j)(4)(A)-(C) punishes those who photograph or film, under the understanding of privacy, a person’s intimate body parts, or a person engaged in intimate acts, and then distributes the images to cause the person emotional distress.

Under this law, the creation and distribution of revenge porn is a misdemeanor offense that is punishable by up to six months in jail and a fine of up to $1,000.

Moore was not charged with violating this law due to a federal law that says website owners cannot be held responsible for user-submitted content. Instead, he was charged with identity theft and federal computer hacking. Moore agreed to a plea agreement filed in U.S. District Court in Los Angeles with terms that include internet restrictions. 2

San Diego Man Guilty of Operating Revenge Porn Site

In February 2015, a San Diego man was found guilty of running a revenge porn site. He is facing up to 20 years in prison. The man posted explicit photos of women submitted by angry ex-boyfriends. Women who found the pictures and asked to have them taken down were asked to pay up to $350.

More than 10,000 pictures were posted on the revenge porn website between December 2012 and September 2013. Court documents show that some of the victims of the site emailed the operator demanding the images be removed. One woman said in her email that she was getting emails, lewd images, and even phone calls from strangers wanting to “hook up” with her after the operator posted her photos along with her name and other personal information. 3
