If you were convicted of annoying or molesting a child under California Penal Code Section 647.6, you are likely required to register as a sex offender for the rest of your life. Is this criminal conviction ruining your life? Do you have difficulties finding suitable housing or maintaining employment because of your registered sex offender status? The good news is there may be a way to end your requirement to register as a sex offender.
Obtaining a Certificate of Rehabilitation may be a way for you to get relief from the sex offender registry. So how do you obtain a Certificate of Rehabilitation?
Certificate of Rehabilitation Process in California
You may be eligible for a Certificate of Rehabilitation in California if you were convicted of:
- A felony for which you received probation
- A misdemeanor sex offense listed under California Penal Code Section 290, OR
- A crime for which you went to prison and were released on parole
This means that you are eligible for a Certificate of Rehabilitation if you were convicted of annoying or molesting a child. However, there are some things you should consider before filing an application.
If you were convicted of a misdemeanor under PC 647.6, you should attempt to have the conviction expunged before you apply for a Certificate of Rehabilitation. If your conviction was a felony, you should speak to an attorney about having that conviction reduced to a misdemeanor then filing for an expungement.
In addition, you are only eligible for a Certificate of Rehabilitation if you:
- Were released from custody for this conviction and have not been incarcerated for another crime since
- Have completed probation or parole and are not on probation or parole for any other felony
- Have lived in California for at least five years before filing your application; AND
- Have waited a satisfactory period to show that you have been rehabilitated
Does a Certificate of Rehabilitation End My Requirement to Register?
For many people who have a child annoyance or molest conviction on their record, the biggest benefit of a Certificate of Rehabilitation is that it could end their requirement to register as a sex offender.
Obtaining a Certificate of Rehabilitation will end your requirement to register as a sex offender if you were convicted of misdemeanor child annoyance or molest. However, if you were convicted of a felony sex crime, a Certificate of Rehabilitation alone will not end your requirement to register. To stop registration, you should seek a Governor’s Pardon or have your attorney attempt to have your felony conviction reduced to a misdemeanor before applying for a Certificate of Rehabilitation.
