Earlier this year it was reported by Sean Emery of the OC Register, that police have arrested a hospital worker, Francisco Ayala Jr., on sexual assault, rape and sodomy charges. The victim, who was a patient at St Joseph’s Hospital, made allegations that Ayala sexually assaulted her in the early morning hours about a week ago.

Ayala was assigned to monitor her hospital stay. Ayala who is a patient-care technician, was apparently alone with the victim when the incident was alleged to have happened. There are no known witnesses to the assault at this time. Ayala provided a statement to officials and was arrested after the interview.

Rape is an act of sexual intercourse accomplished with a person not the spouse of the perpetrator, under any of the following circumstances: (2) Where it is accomplished against a person’s will by means of force, violence, duress, menace, or fear of immediate and unlawful bodily injury on the person or another. Rape is punishable by imprisonment in the state prison for three, six, or eight years.

Any person who commits an act of sodomy when the act is accomplished against the victim’s will by means of force, violence, duress, menace, or fear of immediate and unlawful bodily injury on the victim or another person shall be punished by imprisonment in the state prison for three, six, or eight years.
