Dr. Kevin Pezeshki is accused of inappropriately touching a patient during two hospital exams. He is free on $200,000 bail.
When a doctor is accused of inappropriately touching a patient it is almost always the patients word vs. the doctors word. Sometimes, the accused doctor will have no prior record of any similar incidents and will have been practicing medicine for 20 years or longer. This has to make you wonder if the allegations are true. Why would a doctor choose after all these years to do something sexually inappropriate.
On the other hand you also have to ask why would a patient make such an allegation if it were not true. What motive would a young women have to falsely accuse a doctor knowing that this will require her to come forward in a court of law and testify to the alleged sexual acts?
This is what makes these type of cases so difficult for both sides to the litigation. The consequences to the doctor are extremely high. If he is found guilty he will likely be sentenced to a lengthy jail sentence and have to register as a sex offender. In addition he will likely lose his medical license. Even if he is found not guilty his medical practice will suffer greatly due to the fact that the case has obtained extensive media attention.
If the alleged victim is making allegations that are not true, then it will require a highly skilled sex crimes defense law firm to do extensive discovery to ascertain why she is making false allegations.
