It was recently reported in the OC Register that a sex offender has been charged with sexual battery for assaulting two women and pushing a pregnant lady into the street. Kenneth Anthony Huskey, a registered sex offender in Alaska, was charged with two felony counts of false imprisonment by violence, two felony counts of sexual battery by restraint, and one misdemeanor count of battery. Huskey allegedly harassed women on Main Street in Huntington Beach. Huskey allegedly approached a clerk at a jewelry store and informed her that he was a registered sex offender. Huskey then took the clerk’s phone and obtained her number from it. Huskey also allegedly pushed an eight-month pregnant woman into the street, and blocking another woman and grabbing her crotch and thigh when she tried to get away.

Under California Penal Code Section 243.4, sexual battery is defined as any person who touches an intimate part of another person while that person is unlawfully restrained by the accused or an accomplice, and if the touching is against the will of the person touched and is for the purpose of sexual arousal, sexual gratification, or sexual abuse. Sexual battery is considered to be a “wobbler.” This means that the prosecution has discretion to charge the crime as a felony or a misdemeanor. A felony conviction is punishable by imprisonment in state prison for up to four years and a fine of $10,000. A misdemeanor conviction is punishable by imprisonment in county jail for up to one year and a fine of $2,000. A conviction of sexual battery also requires the defendant to register as a sex offender under the Sex Offender Registration Act. See California Penal Code Section 290.
