In Simi Valley recently, the Simi Valley police arrested a 22-year-old man on suspicion of unlawful sex with a minor under 14 years of age.
Simi Valley resident Spencer Neminski was arrested in the afternoon near the 5000 block of Arroyo Lane. Neminski was charged with lewd/lascivious acts with a minor and was booked at the Ventura County Jail.
According to reports, the 12-year-old female victim went to the Simi Valley Police Department with her mother to report the crime. The victim told police that she met Neminski through friends, and that they agreed to meet that night at his vehicle. The victim says that she and Neminski engaged in consensual sexual acts in the vehicle. When the girl’s mother found out about the conduct she and her daughter went to the police.

To prove that Neminski is guilty of violating Penal Code Section 288(a), the People must prove that:
- He willfully touched any part of a child’s body either on the bare skin or through the clothing; or that he willfully caused a child to touch your own body, or the body of someone else, either on the bare skin or through the clothing;
- He committed the act with the intent of arousing, appealing to, or gratifying the lust, passions, or sexual desires of himself or the child; and
- The child was under the age of 14 years at the time of the act.
