Sex Offender Registration

Alert: Tiered Sex Offender Registration System Takes Effect Jan. 1, 2021 in California (Senate Bill 384)

California lawmakers have introduced a tiered sex offender registration system that will take the place of the current sex offender registry in 2021.

Under the new tiered sex offender registry, some offenders will be able to stop registering after 10 or 20 years. Unfortunately, some will have to register for life. What tier will you fall under? Our knowledgeable sex crimes defense attorneys can help you find out.

Procedure for Stopping Sex Offender Registration under Tiered Registry (SB 384)

Procedure for stopping to register as a sex offender after 10 years or 20 years is still not established. As the days get closer to Jan. 1, 2021, California will develop the following:

  • Procedure to asses what tier you will fall under (i.e. 10 years, 20 years or lifetime), and
  • The proper procedure and paperwork needed to be filed to stop PC 290 sex registration once the required term of 10 or 20 years has passed (SB 384 Petition)

Our lawyers at Wallin & Klarich will carry you through this very important process to get your case into a particular tier and file all necessary paper work to qualify. When you apply to be removed from the sex registry, the paperwork (SB 384 Petition) will also include getting the proper psychological evaluation (Static Risk SARATSO).

Our lawyers have been successfully helping clients obtain post-conviction relief for more than 35 years. Wallin & Klarich will be able to assist you in properly filing a petition under SB 384 to stop your obligation from sex registration in California.

Certificate of Rehabilitation and Governor’s Pardon

Wallin & Klarich has been assisting clients in stopping PC 290 sex registration under current law by seeking a Certificate of Rehabilitation and/or Governor’s Pardon for the past 35 years. Although California will be switching the registry to a tiered system in 2021, we will continue to serve our clients with a Certificate of Rehabilitation and/or Governor’s Pardon until July 1, 2021.

If you wish to apply for a Certificate of Rehabilitation or Governor’s Pardon to stop registering as a sex offender, now is the best time apply. Contact our office so we can discuss how we can help you apply for post-conviction relief before the law changes in 2021.

After that date, our firm will no longer be able to seek relief under the old law for our clients. However, we will continue to assist our clients under the new law that will take effect in 2021.

Please continue to check back for further information as California legislature develops systems and procedure pursuant to SB 384.
