Is a Kiss Just a Kiss?
A kiss is not just a kiss when it is a French kiss on a minor. In a recent court decision, the court held that French kissing between adults and a 12-year-old child who are members of the same household constitutes sexual abuse.
In LA County Dept. of Children and Family Services v. Edwin H., 2011 DJDAR 8713, the appellate court reversed the lower court decision which dismissed the charge in juvenile dependency court, and held that the conduct of Edwin H. toward D.C., a 12-year-old girl who is the daughter of his girlfriend, Reyna F. requires reconsideration and required the offending adult to participate in a sexual abuse program.
The lower court concluded that while the conduct although inappropriate, was not sexual in nature. Edwin is a 32-year-old man who claims to be in love with this 12-year-old girl. He engaged in French kissing her on at least three different occasions.
