Revenge porn banned by Facebook.

Revenge porn has now been officially banned by social media network Facebook. The new rules, published in Facebook’s Community Standards under the Sexual Violence and Exploitation section, say “We remove content that threatens or promotes sexual violence or exploitation. This includes the sexual exploitation of minors, and sexual assault. To protect victims and survivors, we also remove photographs or videos depicting incidents of sexual violence and images shared in revenge or without permissions from the people in the images.” Facebook says that content that violates these guidelines will be removed, and in some instances, referred to law enforcement. 1

Facebook’s ban on revenge porn follows bans by Twitter and Reddit, an online community where allegedly hacked photos of celebrities were recently published.

California Revenge Porn Laws

In 2014, California made creating and distributing revenge porn a criminal offense. Under California Penal Code 647 (j)(4)(A)-(C), it is a misdemeanor to take pictures or videos of the intimate body parts or sexual acts of someone who is identifiable in the images and who believes the images will be kept private, and to distribute those images in order to cause that person serious emotional distress.

If you are convicted of distribution of revenge porn under PC 647 (j)(4)(A)-(C) you face up to six months in county jail and a fine of up to $1,000.

California law also provides for additional penalties that could include probation, counseling, and a court order restraining you from contacting the victim.

One of the elements of a revenge porn crime that must be proven under California Penal Code Section 647 (j)(4)(A)-(C) is that you intended to cause the person depicted in the image serious emotional distress and the victim does indeed suffer that distress. Under Facebook’s new rules, the distribution itself is sufficient to have the images removed. Facebook’s rules are intended to prevent the spread of revenge porn and minimize distress for the victims.
